A revocable living trust, also referred to as an inter vivos trust, is a trust designed to avoid probate while providing long-term property management. The term "revocable" living trust means that the living trust can be terminated or changed at any time during your lifetime. By appointing yourself the trustee of your living trust you retain complete control over assets you place into the trust. Upon your demise, the person you appoint to succeed you as trustee, the successor trustee, distributes the trust assets as you specified, without probate. A revocable living trust is a "living" document which takes effect immediately. A "living" document is a document which may be continually edited and updated by either a limited or unrestricted group. In the case of a living trust, the only person that may edit or update the document is you.

After executing your revocable living trust you then place assets into it. This is called "funding the trust".  You can quickly and easily download living trust forms, establish your trust and transfer assets. Most valuable assets should be transferred into your living trust.  This would include real estate (including homes), business interests, money market accounts, stocks, bonds, mutual funds, precious metals, gems, antiques, artwork, royalty contracts, patents, copyrights, numismatic as well as other valuable collections and other business interests. To establish a revocable living trust, you must execute a Declaration of Trust. Your declaration of trust establishes your living trust and sets forth the terms and conditions. You then transfer assets to yourself as the trustee of your revocable living trust. You then administer the revocable living trust for your own benefit as well as the benefit of at least one other person, a beneficiary. Though your living trust is managed for the benefit of your beneficiaries as well as yourself, beneficiaries get nothing until after your death. Upon your demise, your appointed successor trustee passes revocable living trust property quickly and confidentially to the beneficiaries without probate.
